On New Years Day, 2009.... at approximately 2 am in the early morning..... Twenty-two year old, unarmed Oscar Grant was fatally shot in the back by former BART Police Officer Johannes Mehserle, at the Fruitvale BART Station in Oakland California. Mehserle shot the unarmed Grant with his gun, a SIG Sauer P226, directly  into Grant's back, while he lay on his stomach.... and while BART Officer, Tony Pirone, forcibly held him down by  knelling on Grant's neck.  The .40 caliber bullet from Mehserle's semi-automatic handgun entered Grant's back, exited through his front side and ricocheted off the concrete platform, puncturing Grant's lung.

In essence....Mehserle "executed" Oscar Grant.

According to one witness, Oscar yelled, "You shot me! I got a four-year-old daughter!" Oscar died seven hours later, at 9:13 am, at  in Oakland.
